What are these terms?

These terms and conditions are the terms on which we supply the products available through our website (https://eleanorwellesley.com/) (the "Products")
to you.

How changes can be made these terms?

We may revise these Terms at any time by amending this page. We recommend you check this page from time to time to take note of any changes we have made, as they are binding on you if you place an order after such changes have been made.

For the avoidance of doubt, changes to these Terms will not affect any orders placed before those changes were uploaded to our website.

PLACING AN ORDER

How do I place an order on the Website?

Our website has been designed with you in mind. We aim to make your shopping experience as simple and secure as possible, but in case you need some help to purchase a product from our website, you need to:

simply visit the "Shop" and select which Product you are interested in; once you have decided on a product, if it is in stock, click "Add to Cart";

click the shopping bag icon at the top right-hand corner of the website, ensure that the selection and quantity is correct, then click "Checkout";

review your order details on the right-hand side, where you will be shown a breakdown of the price for your product(s);

provide your email address and shipping information; review and amend your contact details and shipping address. If you would like to receive news and offers via our newsletter, you may indicate this under 'Contact information'. If indicated, we will collect and use your data as set out in our privacy policy.

Once reviewed, select your preferred shipping method and proceed with "Continue to payment"; select "Credit/Debit card" or "Paypal" depending on how you would like to pay, and enter all required payment information. If your billing address is different than your provided shipping address, you may also enter this below your payment details. You will be shown a breakdown of the price and any applicable delivery costs on the right-hand side of the page; and once you are happy that you have entered the correct payment details and have reviewed your order, tick the box indicating your acceptance of these Terms and Conditions and click "Buy now" to complete your purchase.

Please note that unfortunately we cannot add Products to your order once it has been placed.

Once we have received your order, we will send you an email confirming your order to the email address you provided. This email will contain your order number and details of your purchase. We try to ensure that availability information of the Products on our website is correct, but sometimes stock can sell out quickly and it is possible that your order may be accepted for a Product that is out of stock. If the Product you are looking to purchase is out of stock, we will inform you as soon as possible and we will provide you with a refund for the unavailable Product as soon as practicable.

When will I be charged?

The time at which you will be charged for your order will depend on the payment method you selected at checkout. If you choose to pay by card, we will take payment from you immediately when you place your order. If you choose to pay using PayPal, you can choose when you would like to be charged for your order.

If we are unable to take payment from you, we will let you know as soon as possible and you may need to resubmit your order. If we are unable to take payment from you, we are not obliged to fulfil your order.

What should I do if I have made a mistake in my order?

Unfortunately, we are unable to make changes to your order once it has been placed. If you have placed an order for the incorrect Product, you may cancel your order immediately and reorder the correct item. Your statutory cancellation rights and valid periods of cancellation are set out in clause 17 of these Terms and Conditions.

It is your responsibility to ensure that all information provided regarding your billing address, personal details, delivery address and payment method is correct and accurate.

If we cannot place your order, for example because the payment details you provided were incorrect, we will let you know as soon as possible and ask you to resubmit your order. We are not responsible to you if we cannot place your order due to a mistake made by you.

If we try to deliver your order but cannot due to a mistake made by you (e.g. because you provided an incorrect shipping address) and you have not told us about this mistake by contacting customercare@eleanorwellesley.com, you may be responsible for any further delivery or storage costs we have to pay and for any loss or damage to the delivered Products.

SHIPMENT AND DELIVERY

Where do we deliver to?

We deliver worldwide.

For deliveries to the EU and the UK, the price is inclusive of VAT. For deliveries outside the EU (including the Channel Islands and Canary Islands), the price remains the same, but VAT is not charged, and you will not be entitled to VAT refunds.

Shipments within the UK do not have customs or import duties. Customs duties may be payable by customers based outside of the UK. Customs or import duties will be charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel and can also create delays in your delivery. Unfortunately, we have no control over these charges, and cannot tell you what the cost would be, as customs policies and import duties vary widely from country to country.

When will I Receive my Order?

Delivery times will depend on what option you choose for shipping and to where your order is set to be shipped.

Our standard shipping method is £8.00 and 1 to 3 business days, while our express shipping method is the next working day for an additional £10.00 express shipping fee, for addresses within the UK. For international orders, we do not offer express shipping and our standard shipping method will depend on which country you are getting your item delivered to, please check the DHL international shipping method by country at the bottom of Shipping and Returns FAQs.

If you purchase more than one Product at any given time, you will be entitled to free express delivery within the UK. For our international customers, if you purchase more than one Product you will not be charged the international shipping fee, but you may still be liable to pay the relevant customs or import duties depending on where you are based and we have no control over these charges.

We will try to deliver your order according to the timescales for delivery indicated, but very occasionally things can go wrong that are outside of our control. In this case, let us know as soon as you are aware of an issue, and we will aim to send you your order as soon as possible. The longer you wait before letting us know that your order has not arrived, the harder it is for us to trace your parcel and try to
resolve the delay. Even though we will try to resolve the issue, we are not
responsible or liable to you for any delays to your order.

You are responsible for the Products once we deliver your order to your delivery address.

DO YOU DELIVER TO WORK ADDRESSES?

Yes, we deliver to home and work addresses. To add your work address, simply enter the details in the "Shipping address" section when completing your purchase and make sure to enter the correct billing address on the final "Payment" page.

WHERE IS MY ORDER?

We deliver with DPD for the UK and DHL on all international orders. All orders will be shipped to the delivery address at the time of purchase. Once your order has left us, the carrier will retain full responsibility for the shipment. For any lost shipments, international duty charges or damaged shipments, please get in contact with the
carrier directly where a claim may be filed.

Do you have any shops?

No, we are just online for now.

Our Products

We have taken care to describe and portray our Products as accurately as possible on our website. However, Products which you buy from our website may be slightly different to their photographs. The images on our website are for illustrative purposes only and this means that the Product you purchase may vary slightly from those images.

The price of our Products (including any applicable VAT) will be the price indicated on the order page when you place your order (excluding any customs duties or other charges that may be payable in your delivery location). Although we try to make sure that the prices shown on the website and order page are accurate, some of the prices may be incorrect. If we find a mistake in the price of a Product you have ordered, we will not be able to accept your order and we will contact you as
soon as possible to give you the choice of continuing with the order or cancelling it and receiving a refund. If we are unable to contact you, we will treat your order as cancelled.

Minor changes to your order.

We may change the Products you order:

to reflect changes in relevant laws and regulatory requirements; and/or to implement minor technical adjustments and improvements, for example to address a security threat.

In addition to the above, we may make more significant changes to the Products you order, but if we do so we will notify you and you may then contact us to end the contract and receive a refund before the changes take effect.

Can I pre-order items?

Currently, we do not accept pre-orders for our Products. Please follow our socials to find out about our latest arrivals.

The item I want is NOT Available, When Will It Be Back In Stock?

Unfortunately, we cannot promise when out of stock Products will be back in stock, however we try to ensure that details on our stock availability are up to date, and wherever possible provide details on when a Product will no longer be available once it sells out. We recommend that if a particular Product has caught your eye,
and you are unsure about stock availability, reach out to us at customercare@elleanorwellesley.com and we will do our best to provide an accurate date.

RETURNS AND CANCELLATIONS

HOW CAN I MAKE A RETURN?

You have 14 days from receiving your order to exchange or return your order. Under the Consumer Rights Act 2015, you may make a return up to 30 days after delivery of your products if your products are FAULTY. If you place an order for several products and they are delivered separately, then your 30 days will start after you receive the last product in your order.

All items must be returned unused and in their original packaging with all seals and labels intact.

When returning your order, please make sure that you obtain proof of postage (with tracking information) as we are not responsible for any loss or damage to the product when it is being sent to us. The parcel is your responsibility until it reaches our warehouse.

We do not accept returns for faulty products after the 30-day return period. If you try to make a return after this time, we may have to send the product back to you and ask you to cover the delivery costs.

If you would like to make a return, please Contact Us and let us know of the details of your return.

We use DPD for all UK returns and will deduct £10.00 from your total refund amount should you choose to refund any product. We will not deduct any amount if you are simply exchanging a product for another colour or size.

We use DHL for all international returns and will deduct the price of shipping the product to our warehouse from your total refund amount. The amount we will deduct will depend on the country you are returning the products from. You can find further information regarding the shipping charge by country at the bottom of Shipping and Returns FAQs.

Any returns which do not meet the requirements in these terms will not be accepted and you will not receive a refund. We may also reduce your refund if any products are not returned in their original condition or if they have been used, damaged or are in unsaleable condition.

If you have received the wrong item, please Contact Us. For any faulty or incorrect product that you have received, our entire responsibility is to give you a full refund of the amount you paid for the product or send a replacement.

HOW DO I CANCEL MY ORDER?

You have a legal right to cancel your order under the Consumer Contracts Regulations 2013 from the date of your order confirmation until 14 days after delivery of your products. If you would like to cancel your order, we request that you do not accept delivery of the product and inform us of your cancellation as soon as practicable via email. Your cancellation will become effective from the date you send us the cancellation email. This does not affect your 14-day cancellation right.

We will not be able to accept cancellation of a product if it has been accepted upon delivery and is no longer in its original packaging, is unsealed or any tags or labels are no longer intact.

If you choose to cancel your order, you will be liable for your costs of returning the relevant items (including any shipping fee) to the address mentioned at clause 16.8 of these Terms and Conditions. Unless your product is faulty or incorrect, we will
reimburse you the costs of delivery by the least expensive delivery method we offer.

WHEN WILL I RECEIVE MY REFUND?

We will issue a refund as soon as practicable and will try to refund you within 7 working days of your return arriving at our warehouse. We will reimburse you by the same method you used for payment. Please be aware that your chosen payment provider may take additional time to credit the refund.

DISCOUNT CODES

How can I order with a discount code?

If you have a discount code, you must enter it before you proceed to the checkout as you will not be able to apply your discount code once your order is placed. You may only use one discount code per order.

TRANSFER OF RIGHTS

We may transfer our rights and obligations under these Terms, our Privacy Policy and Cookie Policy at any point. You may only transfer your rights or your obligations under these Terms, our Privacy Policy and Cookie Policy to another person only if agreed by both parties in writing.

LAW AND JURISDICTION

All contractual and non-contractual obligations arising out of or in connection with these Terms, our Privacy Policy and Cookie Policy will be governed by and construed in accordance with English law.

The parties subject to these Terms, our Privacy Policy and Cookie Policy irrevocably submit to the exclusive jurisdiction of the English Courts.
